Hellhorse Performance, LLC, a Texas S-Corporation ("Hellhorse," "we," "us," or "our"), located at hellhorseperformance.com, provides high-performance aftermarket automotive parts and services. By purchasing or using our products or services, you ("Customer," "you," or "your") agree to be bound by the following terms, conditions, and policies (collectively, the "Agreement"). This Agreement governs all transactions and interactions with Hellhorse and supersedes any prior or contemporaneous agreements, representations, or understandings, whether written or oral. We reserve the right to amend this Agreement at our discretion without prior notice. The most current version is available at hellhorseperformance.com, and you should review it prior to any purchase.
1. CARB COMPLIANCE POLICY
Hellhorse is committed to compliance with the California Air Resources Board ("CARB") regulations governing vehicle emissions. Certain products are CARB-exempt, having undergone rigorous testing to confirm they do not adversely affect emissions. These products are assigned an Executive Order ("EO") number, displayed via a sticker, metal tag, or direct stamping on the product, which must be visible during emissions testing in CARB-regulated states (e.g., California, New York).
- Non-CARB-exempt products will not be shipped to addresses in CARB-regulated states.
- Customers are solely responsible for verifying product compliance with local emissions laws before purchase.
- For assistance selecting CARB-exempt products, contact us at 1-832-791-2993. Hellhorse is not liable for any penalties, fines, or costs arising from the use of non-compliant products.
2. SHIPPING POLICY
Hellhorse strives to process and ship orders promptly, subject to the following:
- Standard orders are typically processed within 1-2 business days.
- Special orders, including custom exhausts, may require 5-10 business days.
- Supercharger and turbo kits generally require 1-2 weeks for assembly, though delays may occur due to supply chain constraints.
- Backordered items are subject to vendor availability, and estimated shipping windows may change. Customers will be notified of significant delays.
- Free shipping, where offered, applies only to the 48 contiguous U.S. states and excludes oversized items (e.g., engines, differentials) or items with special shipping charges.
- Hellhorse is not liable for delays caused by carriers, supply chain issues, or force majeure events (e.g., natural disasters, labor disputes).
- Customers are responsible for inspecting shipments upon receipt and reporting damage or discrepancies within 48 hours of delivery.
3. RETURNS, CANCELLATIONS, AND REFUNDS
Hellhorse offers limited return and cancellation options as follows:
3.1 Returns
- Unopened standard auto parts may be returned within 7 days of receipt, subject to a 40% restocking fee. Original and return shipping costs are non-refunded.
- Unopened built-to-order supercharger, turbo, or forced induction kits may be returned within 5 days of receipt, subject to a 50% restocking fee. Original and return shipping costs are non-refunded.
- Returns are subject to inspection to confirm uninstalled, original condition. Refunds will be issued within 10 business days of receipt and verification.
- Non-returnable items include custom exhausts, installed parts, wheels with mounted tires, and Palm Beach Dyno tuning services.
- If a free shipping promotion was applied, an additional $10 restocking fee will be charged for returns.
3.2 Cancellations
- Standard orders may be canceled prior to shipment, subject to a 10% credit card processing fee.
- Built-to-order or special orders may be canceled prior to shipment, subject to a 15% cancellation fee.
- Orders already shipped are subject to applicable restocking fees and return shipping costs.
3.3 Sales
- Sale prices are valid only during specified sale periods and cannot be applied retroactively or extended to prior or future orders.
- Hellhorse is not responsible for pricing errors or misprints. We reserve the right to cancel orders affected by such errors.
3.4 Inspection
- Customers must inspect all parts prior to installation and wheels prior to tire mounting. Installed parts or wheels with mounted tires are ineligible for return or refund.
4. DISCLAIMERS AND LIMITATION OF LIABILITY
4.1 Warranty Disclaimer
- All products and services are provided "AS IS" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- Aftermarket parts and custom tuning may void factory or extended vehicle warranties. Customers are solely responsible for verifying warranty implications with their vehicle manufacturer prior to purchase or installation.
4.2 Installation and Vehicle Condition
- Customers assume all risks associated with the installation and use of Hellhorse products. Hellhorse is not liable for damage to vehicles or components resulting from improper installation, pre-existing vehicle conditions, or misuse.
- Customers must ensure their vehicle is in good working condition and capable of handling performance modifications. Hellhorse is not liable for damage caused by vehicle deficiencies or failure to return a vehicle to stock condition if issues arise post-installation.
4.3 Off-Road Use
- Unless explicitly stated as CARB-exempt, all products and services are designated for off-road or sanctioned racing use only and may not be legal for on-road use in states requiring emissions compliance.
- Customers are solely responsible for ensuring compliance with local, state, and federal laws. Hellhorse is not liable for fines, penalties, or damages resulting from unlawful use.
4.4 Product Representations
- Product images and specifications are for illustrative purposes only and may not exactly represent the delivered product. Hellhorse reserves the right to modify images or specifications without notice.
4.5 Safety
- Hellhorse is not liable for accidents, injuries, or damages resulting from improper, reckless, or unlawful use of our products or services. Customers must comply with all applicable laws and safety standards.
4.6 Limitation of Liability
- To the fullest extent permitted by law, Hellhorse's total liability for any claim arising from this Agreement or the use of our products or services shall not exceed the purchase price of the product or service in question.
- Hellhorse is not liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, vehicle downtime, or towing costs.
5. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Hellhorse, its officers, directors, shareholders, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:
- Your violation of this Agreement;
- Your use or misuse of Hellhorse products or services;
- Your violation of any applicable laws or regulations; or
- Any damage or injury caused by your vehicle or its operation after using our products or services.
6. GOVERNING LAW AND DISPUTE RESOLUTION
- This Agreement shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles.
- Any disputes arising under or related to this Agreement shall be resolved exclusively in the state or federal courts located in Harris County, Texas. You consent to the personal jurisdiction of such courts.
- In the event of a dispute, you agree to first attempt resolution through good-faith negotiation. If unresolved after 30 days, either party may pursue legal action.
7. MISCELLANEOUS
- Entire Agreement: This Agreement constitutes the entire understanding between Hellhorse and you regarding the subject matter herein and supersedes all prior agreements.
- Severability: If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Force Majeure: Hellhorse is not liable for delays or failures to perform due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, or supply chain disruptions.
- Assignment: You may not assign your rights or obligations under this Agreement without our prior written consent. Hellhorse may assign its rights at its discretion.
