Hellhorse Performance, LLC, a Texas S-Corporation ("Hellhorse," "we," "us," or "our"), located at hellhorseperformance.com, respects your privacy and is committed to protecting the personal information of our customers and website visitors. This Privacy Policy describes what information we collect, how we use it, who we share it with, and the rights and choices available to you.
This Policy applies to information collected through hellhorseperformance.com and through any related communications, transactions, or marketing programs operated by Hellhorse. By using our website or making a purchase, you acknowledge the practices described in this Policy.
- SCOPE
Hellhorse operates exclusively within the United States. We do not sell or ship to customers outside the United States, and our services are not directed to residents of the European Economic Area, the United Kingdom, or other non-U.S. jurisdictions. Where U.S. residents in California, Texas, or other states have specific rights under state privacy laws, those rights are described in Section 10. A courtesy summary of EU/UK considerations is provided in Section 12 for visitors who reach our site from abroad.
- INFORMATION WE COLLECT
We collect the following categories of information:
- Identifiers: Name, billing and shipping address, email address, phone number (when provided by you at checkout), and account login credentials.
- Commercial Information: Order history, cart contents, products viewed, transaction details, returns, and customer service inquiries.
- Payment Information: Payment card data is collected and processed by our payment processors (including Shopify Payments and other authorized gateways) and is not stored on Hellhorse's servers.
- Internet and Device Information: IP address, device identifiers, browser type, operating system, referring URL, pages viewed, time on site, and clickstream data, collected automatically through cookies, pixels, and similar technologies.
- Vehicle Information: Year, make, model, trim, and modification details that you voluntarily provide for fitment and product compatibility purposes.
- Marketing and Communication Data: Email opt-in status, SMS opt-in status (where applicable), survey responses, and engagement with our emails or ads.
- Inferences: Preferences, interests, and characteristics derived from your activity to personalize content, product recommendations, and marketing.
We do not knowingly collect Social Security numbers, driver's license numbers, financial account numbers, biometric data, precise geolocation, or other "sensitive personal information" as defined under U.S. state privacy laws.

- Directly from You: When you create an account, place an order, contact us, sign up for emails or SMS, or otherwise interact with us.

- From Third Parties: From service providers, advertising platforms, fraud-prevention services, and shipping carriers in connection with the operation of our store.
- HOW WE USE YOUR INFORMATION

- DISCLOSURE OF INFORMATION
We share personal information only with the following categories of recipients:
- E-Commerce Platform: Shopify Inc. hosts our online store and processes order, account, and payment data on our behalf.
- Payment Processors: Shopify Payments and other authorized gateways process transactions and handle payment card data.
- Shipping and Fulfillment Partners: Carriers (UPS, FedEx, USPS, freight providers) and suppliers who fulfill made-to-order or supplier-fulfilled products receive the information necessary to deliver your order.
- Email and SMS Marketing Providers: Klaviyo and similar platforms used to send transactional and marketing communications.
- Advertising and Analytics Partners: Meta (Facebook/Instagram), Google (Ads, Analytics, Tag Manager), and Shopify's analytics tools, which receive event and identifier data through pixels and tags installed on our site for measurement and advertising purposes (see Section 9).
- Professional Advisors: Accountants, attorneys, and similar advisors bound by confidentiality obligations.
- Legal and Safety: Law enforcement, regulators, and other parties when required by law, subpoena, or court order, or when reasonably necessary to protect rights, property, or safety.
- Business Transfers: A successor entity in connection with a merger, acquisition, financing, or sale of assets, subject to confidentiality protections.
We do not sell your personal information for money. However, certain disclosures to advertising platforms (such as Meta and Google) for targeted advertising may qualify as a "sale" or "sharing" of personal information under the California Consumer Privacy Act, as amended by the California Privacy Rights Act. See Section 10 for your rights and choices.
- SHOPIFY AND PAYMENT PROCESSING
Our online store is hosted by Shopify Inc. Shopify provides the e-commerce platform that allows us to sell products and services to you and stores order, account, and analytics data on its infrastructure. Payment card information is handled by PCI-DSS compliant payment processors (including Shopify Payments) and is encrypted in transit and at rest. Hellhorse does not store full payment card numbers.

- ADVERTISING AND ANALYTICS PARTNERS
We use the following third-party tools to operate, analyze, and advertise our store. Each one places cookies, pixels, or similar identifiers on our site:
- Meta Pixel and Conversions API (Facebook, Instagram): Tracks events such as page views, add-to-cart, and purchases for advertising measurement, optimization, and audience building.
- Google Analytics, Google Ads, and Google Tag Manager: Measures site performance, attributes conversions, and supports remarketing campaigns.
- Klaviyo: Powers transactional emails, abandoned-cart flows, and marketing email and SMS programs.
- Shopify Analytics and Shopify Audiences: Provides built-in store analytics and, where enabled, contributes anonymized purchase signals to advertising audiences across the Shopify ecosystem.
You can manage cookies and tracking through the controls described in Section 9 and through the rights described in Section 10.
- SECURITY
We use reasonable administrative, technical, and physical safeguards to protect personal information, including:
- TLS/SSL encryption for data in transit;
- PCI-DSS compliant payment processing;
- Role-based access controls limiting employee and contractor access to information;
- Vendor due diligence for third-party service providers.
No system is perfectly secure. We cannot guarantee absolute security but work to maintain protections appropriate to the nature of the information we handle.
- COOKIES AND TRACKING TECHNOLOGIES
We and our service providers use cookies, pixels, and similar technologies to operate the site, remember your preferences, analyze traffic, and deliver advertising. Common categories include:
- Strictly Necessary: Cookies required for the cart, checkout, login, and security (e.g., Shopify session cookies such as _session_id and _secure_session_id).
- Analytics: Cookies that measure how visitors use the site (e.g., Google Analytics, Shopify analytics).

10.1 California Residents (CCPA / CPRA) California residents have the right to:
- Know the categories and specific pieces of personal information we have collected about them, the sources, the purposes, and the categories of third parties to whom we disclose information.
- Request deletion of personal information, subject to legal exceptions.
- Request correction of inaccurate personal information.
- Opt out of the "sale" or "sharing" of personal information, including disclosures to advertising platforms used for cross-context behavioral advertising. To exercise this right, use the "Do Not Sell or Share My Personal Information" link in our website footer or email support@hellhorseperformance.com with the subject line "Do Not Sell or Share."
- Limit the use and disclosure of sensitive personal information (we do not currently use sensitive personal information for purposes beyond those permitted by default under the law).
- Be free from retaliation for exercising any of these rights.
10.2 Texas Residents (TDPSA) Texas residents have the right, under the Texas Data Privacy and Security Act, to:
- Confirm whether we process their personal data and access that data.
- Correct inaccuracies in their personal data.
- Delete personal data that we process about them.
- Obtain a portable copy of personal data they previously provided.
- Opt out of the processing of their personal data for purposes of targeted advertising, the sale of personal data, or certain types of profiling. Texas residents may exercise the opt-out right through the "Do Not Sell or Share My Personal Information" link in our website footer or by emailing support@hellhorseperformance.com.
10.3 Other U.S. State Residents Residents of other U.S. states with comprehensive privacy laws (including but not limited to Virginia, Colorado, Connecticut, Utah, Oregon, Montana, and others as such laws take effect) may have similar rights to access, correct, delete, port, and opt out of certain processing. We will honor those rights to the extent required by applicable law.
10.4 How to Exercise Your Rights To submit a privacy request, email our privacy team at support@hellhorseperformance.com with the subject line "Privacy Request" or write to the mailing address in Section 14. We will verify your identity before responding (which may include confirming information already on file). We will respond within the timeframes required by applicable law (generally 45 days, with one extension permitted where allowed). Authorized agents may submit requests on your behalf with appropriate documentation.
10.5 No Discrimination We will not deny goods or services, charge different prices, or provide a different level of service because you exercised any of your privacy rights.
- CHILDREN'S PRIVACY (COPPA)
Our website and products are not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13 in violation of the Children's Online Privacy Protection Act. If you believe a child under 13 has provided personal information to us, please contact support@hellhorseperformance.com so we can investigate and delete the information as appropriate.
By using our website or making a purchase, you represent that you are at least 18 years old (or the age of majority in your state of residence) and have the legal capacity to enter into binding agreements.
- INTERNATIONAL VISITORS
Our website is operated from the United States. We do not market to or sell to customers outside the United States. If you visit hellhorseperformance.com from outside the U.S., any information collected will be processed in the U.S., where data protection laws may differ from those in your home jurisdiction. By using our site, you understand that your information will be processed in the United States. Visitors from the EU, UK, or other non-U.S. jurisdictions who wish to inquire about their information may contact us at support@hellhorseperformance.com; we will respond consistent with applicable U.S. law.

We may update this Privacy Policy from time to time to reflect changes to our practices, technology, or applicable law. The "Last Updated" date at the top reflects the latest revision.
